5:05 PM ET – Gubernatorial Candidate Rep. Ron DeSantis of Florida, he is a member of the Freedom Caucus and is a part of the House Oversight Committee, and he is thrilled that Congress is using its constitutional powers to pursue the truth. DeSantis is still very concerned about Mueller and his special counsel. The idea of subpoenaing a sitting President is not out of the realm of possibility:

It has not been settled whether President Donald Trump can be subpoenaed if he does not sit down to answer FBI special counsel Robert Mueller’s questions, Rep. Ron DeSantis, R-Fla., insisted Monday, hitting at another lawmaker’s opinion the president could face subpoenas like former Presidents Richard Nixon and Bill Clinton.

“I disagree with Congressman [Jim] Himes,” DeSantis told Fox News’ “Outnumbered Overtime.” “It’s not settled that the president can be subpoenaed for any reason at all. This is different than what Bill Clinton sat for. It’s different than the Nixon tapes. What Mueller is purporting to do is potentially subpoena the president to conduct oversight over the president’s use of his Article II powers.”

Mueller, he added, is an “inferior officer in the executive branch, so it raises huge separation of powers questions,” DeSantis added. “I’m not sure that the court would force the president to answer questions under those circumstances.” (h/t Newsmax)

5:30 PM ET – Mick Mulvaney, Director of the Office of Management and Budget, wants to address the news on rescissions, and set the record straight on what his office is doing.

A rescissions package arriving on Capitol Hill would claw back $15 billion into the nation’s budget by appropriating funding that has not yet been spent from federal programs, White House budget director Mick Mulvaney said Tuesday.

“It’s money that is either not authorized or not expected to be spent, so we can take the money back without impacting the programs,” Mulvaney told Fox Business’ “Mornings with Maria” host Maria Bartiromo.

Example of a program that would not be impacted: the Children’s Health Insurance Program, Mulvaney said.

“There are other funds that go back to the stimulus, the way it worked back then, it still works this way a little bit, but certainly a lot more under the previous administration was they threw a bunch of money at various agencies and said you can have this money for as long as you want it or need it.” (H/T Newsmax)
