With less than a month to Election Day, the Generic Congressional Ballot is now dead even.

The latest Rasmussen Reports telephone and online survey finds that 45% of Likely U.S. Voters would choose the Democratic candidate if the elections for Congress were held today. Another 45% would opt for the Republican. Three percent (3%) prefer some other candidate, and eight percent (8%) are undecided. (To see survey question wording, click here.)

Last week, 47% of voters said they would choose the Democratic candidate while 42% said they would choose the Republican. It is unclear whether the sudden jump to a tie vote is a reflection of the anger surrounding the Kavanaugh confirmation process, but we will continue to watch this in the weeks ahead.

4:30 PM ET – Chairman of the Freedom Caucus, Congressman Mark Meadows of North Carolina and Congressman Jim Jordan of Ohio, also with the Freedom Caucus, join the show today to discuss Deputy AG Rod Rosenstein’s decision to cancel his closed-door session with the House Judiciary Committee. Meadows and Jordan are discussing this breaking news with Sean exclusively.

Two sources close to the negotiations told Fox News on Wednesday that Rosenstein’s scheduled appearance on Capitol Hill before the House Judiciary Committee may be at an impasse over the terms of the testimony. Some lawmakers are insisting that Rosenstein give a transcribed interview under oath — the standard for congressional task-force interviews.

But those close to Rosenstein prefer a meeting or briefing with the House Judiciary Committee chairman and other lawmakers, where there is no paper trail, the sources said.

A House Judiciary Committee aide on Wednesday left the door open for a possible resolution.

“We have many questions for Deputy Attorney General Rosenstein and expect answers to those questions,” the aide said. “There is not at this time a confirmed date for a potential meeting. Nevertheless, we will continue to provide updates as we have them.”

After eight years in the minority, Democrats have big plans, from shoring up ObamaCare and Dodd-Frank financial rules to protecting “Dreamers” and the integrity of elections.

They are also vowing to aggressively probe the actions of the Trump administration — an oversight role Democrats contend was virtually abandoned by Republicans.

“Basically, a lot of the committees have just been rubber stamps for this administration,” said Rep. Bennie Thompson (D-Miss.), the ranking member of the Homeland Security Committee.

Because Democrats have long honored a system of seniority without term limits, the top Democrats on House panels are considered favorites to jump into chairmanships if control of the House changes hands.
